The California Lemon Law, officially known as the Song-Beverly Consumer Warranty Act is one of this state's major laws which directly aid the consumer. If you've purchased a vehicle in California and you believe you have a lemon, then this is the law for you. And remember, this doesn't just cover automobiles but trucks, SUVs, vans, recreational vehicles, boats, motorcycles, etc. In fact, any vehicle that you paid more than $25 for is not used for business and is still under warranty is eligible to be covered under this law. Obviously, in your opinion it is also unsafe, has defective parts that cannot be fixed and is malfunctioning. This qualifies your vehicle as a lemon.
Okay, we've established that you probably have a lemon. Now what do you do? According to this law you should contact the vehicle manufacturer as well as the dealership and let them know that you have a problem with the vehicle. The dealer will then tell you to bring it in and they will attempt to repair it. After 4 attempts, if the vehicle still has the same issue and can't seem to be repaired and has been in the repair shop for more than 30 days (not necessarily consecutive) then you are ready to file a claim under this law. The only exception to this rule is if you vehicle's malfunction could cause bodily harm or even death. Then, on a case by case basis, it will be determined if you have to bring it 4 times to be repaired. Many times they lower that number to 2 times or even just once.
If you are now at this step, then you probably should get yourself a good attorney. Make sure that they specialize in the California Lemon Law and that is what they do full time. Do not turn your case over to someone who is a part time lawyer or who only does lemon law cases as part of a much bigger practice. This is your money and your lawsuit. You have to hire someone that knows this law and all its intricacies so they can best represent you and your situation.
The best case scenario is finding an attorney who will do a free case evaluation and represent you without any out of pocket expense. How this works is that if you qualify, they will begin the process and hopefully settle the case (which can take from 7-60 days) and how you pay them is a percentage from whatever amount the attorney wins for you. In most cases you will receive reimbursement of money you paid for monthly vehicle payments, rental cars, towing and also you will get a new replacement vehicle of the same make and model.
