Georgia Woman Gets Jailed For Smell Of Alcohol In DUI Case

Police had charged the 28 year old Lauren Nicole Smith of Milton with DUI on September 12, 2008 as she was convicted of drinking-and-driving charges. Police discovered her as she was found stranded in the middle of nowhere with a blood-alcohol level of .34. Apparently, she has been reported to be a drunkard, and her acts proved the point, when failed to even open the door, with her vehicle parked at city center. The normal legal limit of blood-alcohol level to be considered fit for driving is about .08, but the convicted person's level was about four times of the permissible count.

As such, she was brought to court last month for the legal proceedings, but it turned out to be a rather funny incidence, as the Georgian lady once again got into trouble with consumption of alcohol. Apparently, when Ms. Smith turned up in court for answering charges of DUI, she smelled alcoholic, and was caught by the bailiff during the routine weapon check. This resulted in total change in the course of events as her DUI case got shifted to a court date in June, and she ended up spending couple of days in jail for being accused of contempt of court. She was taken to Alpharetta city jail by the Milton police to serve the two-day sentence, which resulted from separate legal proceedings since the law clearly states that nobody is permissible to make a plea in the court of law, when you are intoxicated with drugs or alcohol.

Ms. Smith appears to be a victim of drinking problem, and possibly needs a good DUI attorney now, to represent her case in June. As per the legal point of view, it is firstly difficult to defend DUI cases, but Ms Smith has already made life difficult for herself, by adding to her already problematic lifestyle charges for drinking and driving.

The local DUI attorneys and law firms tried to investigate into the matter, to find out about chances of putting forward an appeal against the latest charges. However, they just discovered that while someone who has merely consumed alcohol can after all make a plea in the court of law, but someone whose senses have been deteriorated to such a level that the individual is not capable of conducting himself or herself in the court of law, may not make a plea, and it is a legal offense to do so.
